Plaintiff, a 17-year-old boy, was sexually harassed while auditioning for a role in a film that was to be based, in part, on his life story. The film producers promised him a role in the film if he were to provide them sexual favors, which he did.

The film was never produced and when Winer, McKenna, Burritt & Tillis LLP brought the sexual harassment case, the main producers of the film claimed no assets. Thus, Winer, McKenna, Burritt & Tillis LLP had to turn to one of the peripheral film producers to attempt to obtain a recovery on behalf of Plaintiff.

Through investigation and discovery, Winer, McKenna, Burritt & Tillis LLP was able to prove that the peripheral producer in fact did not fulfill his promises to Plaintiff’s parents to watch over Plaintiff when he came to Hollywood. Based on his lack of supervision of Plaintiff, this sexual harassment was allowed to occur.

The defense in return claimed that Plaintiff was a drug addict and despite his claim of being heterosexual frequented gay bars.
Winer, McKenna, Burritt & Tillis LLP claimed that this information was irrelevant to the sexual harassment claim and thus was able to resolve the case short of trial.

RESULT: Settlement on behalf of Plaintiff for $184,250.
