Plaintiff was a 15 year old girl who was recovering from a significant brain surgery at a hospital. Plaintiff alleged that a neurosurgeon who was following her recovery molested her two times. Plaintiff reported the first molest to her mother. Her mother reported the molest to the hospital and asked them to make sure that it never happened again. The hospital failed to take appropriate action and the second molest occurred.

The mother reported the second molest, but the chief of the Neurosurgery Unit refused to believe plaintiff’s claim and supported the alleged perpetrator.

Winer, McKenna, Burritt & Tillis LLP were retained the represent plaintiff. The law firm was able to establish the credibility of plaintiff’s claim and her mother’s testimony that she reported the molest and the hospital failed to act. Further, the value of the case became “spiked” when the head of Neurosurgery refused to accept accountability for the acts of the perpetrating neurosurgeon.

RESULT: Settlement on behalf of plaintiff, $500,000.
