$450,000 -- Woman Brings Sexual Harassment Claim Against Government Entity
Plaintiff in this case was an approximately 40-year-old woman who worked in the janitorial department for a public entity. She claimed that she was sexually harassed by two co-workers and when she complained about the harassment, the public entity failed to take appropriate corrective action and in fact retaliated against her.
The public entity claimed that plaintiff waited too long to bring her civil suit for sexual harassment; that the harassment that existed was insufficient to be actionable and that plaintiff voluntarily participated in sexual interactions with at least one of the perpetrators.
The Law Offices of Winer, McKenna & Burritt, LLP focused the case on the inadequate investigation as opposed to the sexual harassment, which, was relatively minor, consisting of sexual gestures and comments without any touching. The law firm claimed that the investigation was wholly inadequate and took far too long. In fact, investigation took almost two years.
Despite the fact that $330,000 was the most money that this public entity had ever paid for a sexual harassment case, the Law Offices of Winer, McKenna & Burritt, LLP was able to achieve a settlement for $450,000.
RESULT: $450,000 settlement on behalf of plaintiff.
