Plaintiffs, two women in their late 20s, alleged that they were sexually harassed by their 70+-year-old department supervisor. Plaintiffs alleged that this supervisor would make sexual comments to them and would frequently brush up against their buttocks when walking behind them.
The defense claimed that whatever touching occurred was unintentional (he would brush up against Plaintiffs to maintain his balance) and that defendant perpetrator was essentially too old to engage in the conduct alleged by Plaintiffs.
